Terms of Use

What this document covers

These terms (the "Terms") govern the use of the Tonus app for iPhone (the "App"), developed and published by Yunimo OsOO ("we"). By installing or using the App you accept the Terms. If you do not agree with them, do not use the App.

Data processing is described in the Privacy Policy, which is part of these Terms.

What the App does

The App offers gym and home workout programs, a workout log, a food diary with photo and text recognition, and a daily calorie target. Some features are free, others require the Tonus PRO subscription.

Not a medical service

The App is for information only and is not a medical service, diagnosis or prescription. Workout programs, calorie targets and food estimates are calculated with general formulas and do not account for every aspect of your health.

Consult a doctor before starting training or changing your diet, especially if you have a chronic condition, are pregnant or breastfeeding, have a history of eating disorders or have had surgery. You are responsible for decisions about your health and the load you choose.

Accuracy of food recognition

The contents and calories of meals are determined automatically from a photo or a description and are an estimate. The App shows where the numbers come from: a label, a food database, the manufacturer's website or the model's estimate. Check the result and correct it when needed. We do not guarantee the accuracy of estimates and are not liable for decisions made on their basis.

Tonus PRO subscription

• The subscription unlocks full access to programs and videos and unlimited food recognition. Without it a limited number of recognitions is available.
• The subscription is purchased and billed through the App Store under Apple's rules. The price and duration are shown before purchase. If a free trial is offered, the fee for the chosen period is charged when the trial ends unless you cancel at least 24 hours before the end of the period.
• The subscription renews automatically for the same period until you cancel it in your Apple ID settings. Cancellation takes effect at the end of the paid period; the current period is not refunded.
• Refunds are handled by Apple under its rules. We have no access to your payment details.
• A purchased subscription can be restored on another device with the same Apple ID using Restore Purchases.

Your account and data

The Nutrition section creates an anonymous account without registration. It is tied to your device and survives reinstallation. You can delete it with all its data in the App at any time. The free recognition limit is counted per account and is not reset by reinstalling.

Rules of use

• Use the App for personal purposes only.
• Do not try to bypass limits, interfere with the server, forge requests or access other people's data.
• Do not submit images unrelated to food or materials that violate the law for recognition.
• Do not copy, distribute or resell the App's content: programs, videos, texts and design belong to us or our licensors.

If these rules are broken we may restrict or terminate access to the App or its server features.

Availability and changes

We work to keep the App and the server running without interruption but do not guarantee constant availability. Food recognition depends on third-party services and may be temporarily unavailable. We may change, add or remove features and update these Terms. The new version is published on this page with the date at the top; continued use after publication means you accept it.

Liability

The App is provided "as is". To the extent permitted by law we are not liable for indirect losses, injuries or harm to health arising from the use of workout programs, nutrition recommendations or food estimates, or from the App being unavailable. Our total liability is limited to the amount you paid for the subscription in the last 12 months.

Apple

The App is distributed through the App Store. Apple is not a party to these Terms and is not responsible for the App or its support. If the App fails to conform to a warranty, you may contact Apple for a refund within the limits of App Store rules.

Governing law and disputes

The Terms are governed by the law of the country where the company is registered. Before going to court, write to us: most questions are settled by correspondence. If any provision of the Terms is found invalid, the remaining provisions stay in force.
